These terms are an agreement between you and Hangzhou Yuyan Intelligent Co., Ltd (杭州宇言智能有限公司), "we" in these terms, the maker of Tides Photos. They cover the Tides Photos app for iPhone and iPad, its AI assistant, and this website (together, "Tides Photos"). By using Tides Photos, you agree to these terms. If you don't agree, don't use Tides Photos.
Our Privacy Policy explains how Tides Photos handles your data. If you got Tides Photos from the App Store, Apple's Licensed Application End User License Agreement (the "Apple EULA") also applies and governs your license to use the app; these terms add to it.
The short version
- Tides Photos is free. There's no account and no subscription.
- Your photos and edits are yours. Only edit photos you have the right to use.
- The AI assistant can be wrong. Look over its edits before you export or share.
- DeepSeek, Apple and the apps you share to have their own terms, and any charges from an AI provider are yours.
- Don't use Tides Photos to make illegal content or to deceive people with altered images of real people.
Who can use Tides Photos
You must be at least 13 years old to use Tides Photos. If you're under the age of majority where you live, you need a parent or guardian's permission, and they agree to these terms for you. You can't use Tides Photos if the law forbids you from doing so.
Price
Tides Photos is free to download and use. It has no in-app purchases or subscriptions. If that ever changes, the App Store will show the price before you pay, and Apple will handle billing.
Your content
"Your content" is what you bring into or make with Tides Photos: your photos, edits, text, drawings, imported fonts, saved looks and text styles, collages, exports, and what you ask the AI assistant. You keep all rights to it. Your projects stay on your device, and we don't receive them in normal use, so we don't need or claim any license to them, except that when you use the AI assistant, the app sends the parts of a request that the Privacy Policy describes to the AI provider you've chosen.
You're responsible for your content. Before you edit, export or share a photo, make sure you have the right to use it, including any people, artwork, trademarks or fonts in it, and the right to change it the way you do.
The AI assistant
The AI assistant is optional. You describe an edit in your own words, an AI provider plans the changes, and the app applies them as regular edits you can adjust or undo. AI can misunderstand you or produce results you didn't expect, and its suggestions may be inaccurate. Review the results before you export or share them; you're responsible for the edits you keep.
The assistant needs your own API key and an internet connection, and works only after you allow photo uploads. Don't use it to create content that breaks the rules below.
Third-party services
Tides Photos works with services that other companies provide, such as DeepSeek or another AI provider you choose, Apple's Photos, Image Playground and Apple Intelligence, and Instagram, TikTok or other apps you share to. Your use of those services is governed by their own terms and privacy policies, and we aren't responsible for them. You're responsible for any charges from your AI provider for requests made with your API key, and for keeping that key secure.
Rules for using Tides Photos
When you use Tides Photos, don't:
- Make or share content that is illegal, harassing, hateful or threatening, that exploits or endangers children, or that shows someone in a sexual or intimate way without their consent.
- Edit images of real people in ways that infringe their rights or deceive others, such as fake images meant to mislead, defame, harass, or impersonate someone.
- Infringe anyone's copyright, trademark, privacy or other rights, including by removing watermarks or other marks of ownership you don't have the right to remove.
- Use Tides Photos for fraud, or to break the law.
- Use the AI assistant to get around an AI provider's own rules, or to overload or misuse its service.
- Copy, modify, decompile or reverse engineer Tides Photos, except where the law or an open-source license allows it despite this rule.
- Resell Tides Photos, or use it to build a competing product.
To report misuse or ask about these rules, email support.customer@language-ai.cn.
Open-source components
Tides Photos includes open-source models that run on your device, used under their licenses:
- Segment Anything 2.1, under the Apache License 2.0.
- LaMa, under the Apache License 2.0.
- BiRefNet, under the MIT License.
Those licenses apply to those components, and nothing in these terms limits the rights they give you.
Our rights
Tides Photos, including its software, design, name and logo, belongs to us and our licensors and is protected by intellectual property law. These terms and the Apple EULA give you a personal, non-transferable right to use Tides Photos; they don't give you any other rights in it. If you send us feedback or ideas, we can use them without owing you anything.
Changes to Tides Photos
We're always working on Tides Photos, so features can change, and we may add or remove them. Features that rely on other companies, such as the AI assistant, can stop working if those services change. Your projects stay on your device; export anything important.
Ending these terms
You can stop using Tides Photos at any time by deleting the app. The sections on your content, our rights, disclaimers, liability and disputes continue after these terms end.
Disclaimers
We work hard to make Tides Photos reliable, but we provide it "as is" and "as available". To the extent the law allows, we make no promises beyond those in these terms, including that Tides Photos will be uninterrupted or error-free, that AI results will be accurate, or that your projects can't be lost. Projects live only on your device and aren't backed up by us, so keep copies of anything important.
Limitation of liability
To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of Tides Photos. Our total liability for all claims about Tides Photos is limited to the greater of the amount you paid for Tides Photos in the 12 months before the claim, or US$50.
Nothing in these terms limits liability that the law doesn't allow to be limited, such as for death or personal injury caused by negligence, or for fraud, and nothing in them takes away rights you have as a consumer under the law where you live.
To the extent the law allows, you'll compensate us for losses and reasonable costs from third-party claims caused by your content or by your breaking these terms.
Disputes
If you have a problem with Tides Photos, please email us first; most issues can be fixed quickly. If we can't resolve a dispute within 30 days, it will be governed by the laws of the People's Republic of China, without regard to conflict-of-law rules, and decided by the courts with jurisdiction where we're located in Hangzhou. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live and can bring a claim in its courts.
About Apple
These terms are between you and us, not Apple. Apple isn't responsible for Tides Photos or its content, and has no obligation to provide maintenance or support for it. If Tides Photos fails to meet a warranty that applies to it, you can notify Apple, which may refund the purchase price; beyond that, Apple has no warranty obligation for Tides Photos. We, not Apple, are responsible for handling any claims about Tides Photos, including product liability, legal or regulatory compliance, consumer protection, and claims that Tides Photos infringes someone's intellectual property. You confirm that you aren't in a country subject to a US Government embargo and aren't on a US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you.
General
These terms, the Privacy Policy and the Apple EULA are the whole agreement between you and us about Tides Photos. If a court finds part of these terms unenforceable, the rest still applies. If we don't enforce a term right away, we can still enforce it later. You can't transfer these terms to someone else; we can transfer them to a company that takes over Tides Photos, and your rights under them stay the same. If we offer these terms in another language and the versions differ, the English version applies.
Changes to these terms
We may update these terms. We'll post the new version here and change the effective date at the top. If a change materially affects your rights, we'll also tell you in the app where we can, before it takes effect. If you keep using Tides Photos after a change takes effect, you accept the new terms; if you don't, stop using Tides Photos.
